Agreement for Website Design & Hosting

 

Between HGD Media GmbH, hereinafter referred to as “HGD Media,” and the above-listed business client (hereinafter “Client”), the following agreement is made:

 

§ 1 Subject of the Agreement

The subject of this agreement is the development and creation of a website for the Client, including two revision rounds, enabling the Client to establish an online presence. HGD Media will first develop an initial design draft for the website. Multiple drafts may be created until one is approved by the Client. After approval of the initial draft, HGD Media will build the website based on that design. The Client shall provide all required content (checklist, logo, texts, and images) within 14 days from the date of order placement. The following service is commissioned in accordance with webdesign-dubai-concept.com:

§ 2 Web Service and Domain

HGD Media also provides the acquisition of web server storage space on which the contractual website will be hosted and supplies the web service (license, webspace, maintenance, and support). HGD Media is commissioned to register a new domain or to transfer an existing domain of the Client, as well as to set up email addresses linked to the domain. All rights, name rights, and costs associated with the domain — amounting to €3 per month — remain with the Client/domain owner, who is also responsible for regularly backing up their email mailboxes. In all other respects, § 5 of HGD Media’s General Terms and Conditions (see § 5 of this Agreement) shall apply.

§ 3 Compensation

HGD Media shall receive the following remuneration for its services under this agreement:

All fees are exclusive of statutory VAT. The down payment becomes due upon signing of this contract. The final payment and the ongoing monthly fee become due upon commencement of the web service (see below).

§ 4 Term

The contract for the Web Service may be terminated with three months’ notice to the end of any twelve-month period, but not before the expiration of a minimum contract term of 36 months, commencing on the

§ 5 General Terms and Conditions (GTC) and Miscellaneous

The General Terms and Conditions (GTC) of HGD Media GmbH, which are attached to this agreement, shall apply. No supplementary agreements have been made.
Any amendments to this agreement, including this clause, must be made in text form (letter, fax, or email). By signing, both parties confirm that they have each received one copy of this agreement and the General Terms and Conditions of HGD Media GmbH.
